This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Nagpur.

A.K. Fresh Mart reserves the exclusive right to refuse or cancel any transaction/order for products and services that are listed at an incorrect price or are not available. This is enforceable irrespective of order confirmation or payment confirmation. In such events if the payment has been processed by A.K. Fresh Mart the amount will be full refunded via the same mode of original payment and User will be notified of the same with a reasonable mode of communication.

After placing an order A.K. Fresh Mart will not entertain any User request for order cancellations. Kindly refer to the Cancellation policy for further details.

A.K. Fresh Mart will only process the order after the payment has been processed in case of online payment. A.K. Fresh Mart will try to deliver the products as per the order submitted by the user, but it fully reserves a right to deliver a similar or alternate product for reasons beyond its control and any such action shall not be deemed as bad-delivery. The User does not have the right to refuse the order at the time of receipt of the ordered items and shall duly make the payment in case of Cash on Delivery payments.

The title and the risk of the products shall pass onto You upon A.K. Fresh Mart delivering the products to you and you accepting the products. Every care shall be taken to deliver the goods to the intended recipient. But A.K. Fresh Mart shall not be held responsible for any wrong delivery of the product based on the address given by the User or if any person imposes to be the actual recipient and takes delivery of goods. If an order is placed using CCAvenue as the payment mode then the entire order must be paid using CCAvenue and no cash will be accepted for the balance of the order. If the CCAvenue is detected as fraudulent up to a month after the CCAvenue are received, then we will require you to pay for the order with cash. After the delivery is completed absolutely no returns, replacements or refunds will be honored if the payment is made using CCAvenue. All returns must be made at the time of delivery only and the appropriate amount will be deducted before making the payment with CCAvenue. A.K. Fresh Mart reserves the right to decline the entire order or the use CCAvenue if any misuse is detected.
